OPEN PUBLIC MEETINGS
ACT STATEMENT
A meeting of the Board of Commissioners
of the Borough of Cape May Point was called to order on Tuesday, December 8,
2009 at 8:30 a.m. the Conference Room at the Municipal Building located at 215
Lighthouse Avenue. Mayor Schupp announced that this meeting having been properly
posted and advertised, was being in accordance with the Open Public Meetings of
1975 (N.J.S.A. 10:4-6) also known as the Sunshine Law. The Municipal Clerk took the following roll
call vote:

The
Board of Commissioners reviewed the tentative agenda for the Thursday, December
10, 2009 meeting.
Bruce
Graham, PE of Van Note-Harvey, gave the Board of Commissioners a training
seminar on stormwater management in accordance with
our Tier A Stormwater Pemit. Mr. Graham
explained the point system which outines the municipalities
approved activities. He reviewed the
DEP’s posters and newsletters. He stated that the main goal of stormwater management is to reduce pollution in open
waters. Mr. Graham stated that he sat on
the board that reviewed current Stormwater regulations
and reported that some of the rules, which were expensive to comply with were relieved due to the current economic
situation. Mr. Graham explained that the
Borough of Cape May Point is a Tier A municipality. He stated all but one of Cape May County’s
municipalities are “Tier A” except Woodbine.
Mr. Graham explained that the 2009 permit renewal expands the public
education activities and creates the need to have a vehicle wash station in
each municipality that captures the wash water and separates oil from the waste
water from the washing of vehicles. Mr. Graham stated that the DEP would be
holding a 2010 Municipal Stormwater Workshop on
February 11, 2009 10:00 am to 1:00 pm in Atlantic County. He suggested that at
minimum Bill Glbson attend.
Commissioner
vanHeeswyk stated that our Tax Collection rate is
currently 98.76%, which is quite impressive under the economic
circumstances. She stated that the Fixed
Asset Inventory stickers are now in and the inventory database is being
compiled by Commissioner Nietubicz. Commissioner vanHesswyk stated that since the file cabinets and
desks have already been assigned numbers those same numbers will be utilized
when compiling the inventory.
Commissioner
Schupp stated that the much anticipated dumpster
will be available as of January 1st.
He stated that it would be open on Saturdays from 9-11 am. and also by appointment by simply calling the Public Works
Department and arranging a time for drop-off.
Commissioner Schupp stated that he would be
asking our employees currently enrolled in the SHBP to participate in a survey
for ACMJIF Health care.
Commissioner
Schupp asked Commissioner Nietubicz
to continue serving on the Cape May County Animal Shelter Advisory Board. He agreed.
The Municipal Clerk was instructed to respond to Freeholder Desiderio’s letter in writing as to Commissioner Nietubicz’s appointment.
Commissioner MUA Commissioner Schupp announced
that the MUA would be offering free Christmas Tree
mulch in January. He stated that he
would be supplying everyone with an article in today’s newspaper concerning
fertilizer. Commissioner
Schupp refered to a Mayor’s
Fax Advisory regarding the proposed increase in power to the Local Unit
Alignment. He asked the Clerk to
draft a resolution opposing Speaker Robert’s Assembly Bill A-3119. Commissioner Schupp
stated that he also would like to oppose A-4280 and S-3045, which would
effectively eliminate the “time of decision” rule and grant protection to an
application once it has been submitted for consideration. He again, asked the
Municipal Clerk to draft a resolution. Commissioners Nietubicz
and vanHeeswyk disagreed. The board
agreed not to draft said resolution.
Commissioner
Schupp referred to an email from a NJ Watershed Ambassador,
Daniel McLaughlin. The email suggests a
public presentation on watershed management in Cape May Point. Commissioner Nietubicz
offered to respond by email that we would in fact like to hold a public
presentation when more people are town.

Commissioner vanHeeswyk
asked the Clerk to write a resolution to appoint a new CFO in January.
The Board of Commissioners agreed to introduce a
resolution authorizing an executive session so that they could discuss the
court negotiations with West Cape May.
The
Clerk read the following resolution aloud...
RESOLUTION NO. 96-09
WHEREAS, NJSA 10:4-12 Allows
for a Public Body to go into closed session during Public Meeting; and
WHEREAS, the Governing Body
of Cape May Point has deemed it necessary to go into closed session to discuss
certain matters are exempted from the Public; and
NOW,
THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Cape
May Point, in the County of Cape May And State of New
Jersey will go into closed session for the following reason(s) as outlined:

adopt Resolution 96-09 which was seconded by Commissioner Nietubicz. The Municipal Clerk took the following roll
call vote:

After
closed session, the meeting reconveniened at 10:35 am. The board agreed
to introduce the following resolution:
RESOLUTION NO. 97-09
AUTHORIZING THE
BOROUGH ADMINISTRATOR TO NOTIFY THE BOROUGH OF WEST CAPE MAY OF THE BOROUGH OF
CAPE MAY POINT’S
INTENTION TO TERMINATE IT’S PARTICIPATION IN THE INTERMUNICAL
COURT
WHEREAS, Board of
Commissioners of the Borough of Cape May Point desire to give notice to the
Borough of West Cape their intention to dissolve the West Cape May-Cape May
Point Intermunicipal Court; and
WHEREAS, the governing body
acknowledges that the 9-year contract commencing January 1, 1986 has never
successfully been renegotiated , although the Borough of Cape May Point has
made payments to the Borough of West Cape May to continue the court; and
WHEREAS, it is in the best
interest of the taxpayers of the Borough of Cape May Point to abandon the
expired contract in accordance with its provisions.
NOW THEREFORE BE IT
RESOLVED,
by the Board of Commissioners of the Borough of Cape May Point, in the County
of Cape May And State of New Jersey that the Borough Administrator is hereby
authorized to notify the Borough of West Cape May of its intention to
dissolve the agreement as to the Intermunicipal Court
of the Boroughs of West Cape May and Cape May Point.
Commissioner
Nietubicz made a motion to adopt which was seconded
by Commissioner vanHeeswyk. The Municipal Clerk took a roll call vote as
follows:

PUBLIC PORTION
Sally Sachs commented
that many of Cape May Point’s residents have removed their trash
corrals. She asked if Public Works is available to
help those residents that cannot move the
corrals
themselves. Mayor Schupp
stated that we will gladly help those individuals and
encouraged people to
call.
Upon motion by Commissioner Nietubicz,
seconded by Commissioner Schupp the meeting was
adjourned at 10:40 am.
